Guidelines for Third Parties Using MineSec Brand Assets, Trademarks and Copyrights

These guidelines provide clear direction to third parties seeking to use any of MineSec's trademarks, logos, brand marks, service marks, copyrighted materials, or other intellectual property (collectively referred to as "MineSec IP"). Unauthorized use or misuse of MineSec IP can harm our brand, reputation, and legal standing. This document outlines acceptable usage practices and procedures for seeking permission to use MineSec's intellectual property.
  1. Introduction

    MineSec is a trusted provider of innovative SoftPOS solutions. We protect our intellectual property to ensure our brand and products are represented consistently and correctly. These guidelines help you understand how to use MineSec’s brand assets and copyrighted materials in a way that aligns with our standards and protects our brand integrity.

  2. General Principles
    1. Respect for MineSec IP: All uses of MineSec IP must comply with these guidelines and applicable laws.
    2. No Implied Endorsement: You cannot imply or suggest that your products, services, or organization are endorsed or affiliated with MineSec unless explicitly permitted in writing.
    3. Accurate and Proper Use: Ensure that you are using MineSec IP in its correct form, in accordance with the specifications provided, to avoid any confusion or misrepresentation.
  3. Trademarks and Logos
    1. Authorized Use: You may only use MineSec’s trademarks or logos with prior written approval from MineSec. Submit your request to marketing@minesecsoftpos.com.
    2. Access Brand Assets: Access our official logos and brand assets at https://brand.minesec.tools/elements/logo.
    3. Usage Guidelines:
      1. Size and Placement: Use logos in a clear, legible, and prominent manner, ensuring they are not distorted, stretched, or obscured.
      2. Color Accuracy: Maintain the correct color palette for all logos.
      3. Backgrounds: Avoid placing logos on busy or distracting backgrounds.
      4. Combination with Other Marks: Do not combine MineSec logos with other trademarks or logos in a way that creates confusion.
    4. Prohibited Uses:
      1. Unlawful or Misleading Use: Do not use MineSec trademarks in any way that is unlawful, misleading, or could harm MineSec's reputation.
      2. Use in Company Names: Do not incorporate MineSec trademarks into your company name, product names, or domain names.
      3. Unauthorized Modifications: Do not alter, modify, or create derivative works of MineSec logos without written permission.
  4. Copyrighted Content
    1. Authorized Use: You may not use MineSec’s copyrighted materials (e.g., software, documentation, images, videos) without express written permission.
    2. Fair Use: Limited exceptions may apply under applicable copyright law (e.g., for criticism, commentary, news reporting). However, any such use must be fair and not infringe on MineSec's rights.
    3. Prohibited Uses:
      1. Unauthorized Reproduction: Do not reproduce, distribute, or publicly display MineSec's copyrighted content without permission.
      2. Derivative Works: Do not create derivative works based on MineSec's copyrighted content without written consent.
  5. Permitted Use Scenarios (with Prior Written Approval)
    1. Marketing and Sales Materials: You may use MineSec trademarks and logos in marketing and sales materials related to MineSec products and services, subject to specific guidelines and approval.
    2. Press Releases and Media Coverage: Media organizations may quote or reference MineSec trademarks and copyrighted materials in press releases and news articles, provided the content is accurate and not misleading.
    3. Product Reviews and Comparisons: Third-party reviews and comparisons may reference MineSec trademarks and products, provided the use is fair, accurate, and does not imply endorsement.
  6. Approval Process
    1. Submit a Request: To request permission to use MineSec IP, submit a formal request to marketing@minesecsoftpos.com including:
      1. Purpose of Use: Clearly describe how and where you intend to use the MineSec IP.
      2. Scope of Use: Specify the duration of the intended use.
      3. Materials: Provide any relevant materials (e.g., advertisements, website drafts, press release).
    2. Review and Response: We will review your request and respond within 5-10 business days. If your request is time-sensitive, please indicate this when submitting, and we will prioritize accordingly.
  7. Prohibited Actions
    1. Unlawful or Misleading Use: Using MineSec IP in connection with any unlawful, defamatory, or misleading activities.
    2. Disparaging Use: Using MineSec IP in a way that disparages, tarnishes, or harms MineSec's reputation.
    3. Violation of Law: Using MineSec IP in violation of any applicable laws or regulations.
  8. Ownership and Rights
    1. MineSec Retains Ownership:MineSec retains all rights, title, and interest in its trademarks, copyrights, and other intellectual property.
    2. No License Granted: These guidelines do not grant any license or other rights in MineSec IP.
  9. Termination

    MineSec reserves the right to revoke permission for use of its intellectual property at any time, at our sole discretion. Upon termination, you must immediately cease all unauthorized use and remove any related materials.

  10. Indemnification

    You agree to indemnify and hold MineSec harmless from any claims, damages, losses, or expenses arising from your unauthorized or improper use of MineSec IP.
